If you’re having a problem with Apple Card, our attorneys may be able to help. Apple Card is a credit card program run by Goldman Sachs, an investment bank, under the Apple brand name. It can be used as a virtual credit card on the iPhone – but a lot of people have had complaints about it, so much so that Apple is moving to a new bank to operate it in a couple of years.

Those deceptive practices included misleading consumers to think that purchases would automatically be involved in the Apple Card Monthly Installments program and failing to investigate disputes from customers.

That’s a big deal because federal laws called the Truth In Lending Act and the Fair Credit Billing Act require credit card companies to investigate your disputes. If you dispute a transaction for fraud, for example, they have to actually do an investigation for any errors or fraud you report, and what you owe on a fraudulent transaction is limited if you report it quickly. The federal agency said that Apple and Goldman Sachs had ignored tens of thousands of disputes from their customers on Apple Card and just didn’t investigate them at all.

What can an attorney do to help me if Apple Card refused to investigate?

We can use laws like the Fair Credit Billing Act to sue for violations of the law. And it’s important that one of the things you can win under that law is attorney’s fees, which means we can take these kinds of cases on a contingent fee. You can also get any damages, as well as a penalty by law of up to twice the amount of the charge.

What’s a contingent fee?

That’s when we only charge you if you win, and it comes out of whatever you won. So you don’t have to pay anything out of pocket, and if we don’t win your case, you don’t owe us a fee. Many state and federal laws have what’s called “fee shifting” for cases where the dollar amount is too small to hire an attorney. For example, if you lost a few thousand dollars to fraud and you disputed it, you’d never be able to pay an attorney out of pocket to sue. But a few thousand dollars is a big deal to a regular person, and so it’s important that they be able to fight back against big banks that don’t treat them well.
